Will You Repay NELFUND If You Don’t Get a Job? Here is What the Law Says 

Graduating from university is one thing; finding a job afterward is another.

So, if you received a NELFUND student loan while in school but graduate without securing employment, what happens to the money you owe?

Do you immediately start repaying the loan? Can NELFUND demand payment from you while you are unemployed? Does the loan eventually disappear if you remain without a job?

The answer is more complicated than simply saying “yes” or “no.”

Under the Students Loans (Access to Higher Education) Act, 2024, repayment is linked to employment, while the law also provides a mechanism for an unemployed beneficiary to obtain an extension of enforcement by making the required declaration. NELFUND’s current loan terms also contain provisions on repayment, employment and loan recovery.

Here is what NELFUND beneficiaries need to know.

Quick Answer: Do You Repay NELFUND If You Don’t Get a Job?

Not immediately if you are genuinely unemployed and have no income.

Section 28 of the Students Loans (Access to Higher Education) Act, 2024 provides that a beneficiary begins repayment after graduation once the beneficiary has secured employment in any capacity.

The Act also says NELFUND cannot initiate enforcement action until two years after completion of the National Youth Service Corps programme or exemption from it. It further provides for an extension where a beneficiary is not employed and is not receiving any income, subject to the procedure prescribed by the Fund.

However, this does not mean the loan has been cancelled or forgiven simply because you are unemployed.

The debt remains an obligation unless a lawful exemption or other applicable arrangement applies.

When Does NELFUND Loan Repayment Begin?

The 2024 Act provides that a beneficiary shall commence repayment after graduating from the course for which the loan was obtained and securing employment in any capacity.

The law also provides that NELFUND shall not initiate enforcement action against a beneficiary until two years after completion of NYSC or exemption from it.

NELFUND’s current student-loan portal similarly states that payment of the student loan begins two years after NYSC.

This means graduates need to understand two separate issues:

  • When repayment becomes applicable after employment
  • When NELFUND can begin enforcement action

They are related, but they are not exactly the same thing.

What Happens If You Graduate But Cannot Find a Job?

This is where the law becomes particularly important for unemployed graduates.

Section 28(5) of the 2024 Act provides that a beneficiary may receive an extension from NELFUND by providing a sworn statement, in the manner determined by the Board, stating that the person is not employed in any capacity and is not receiving any income.

In simple terms, being unable to find employment can affect when repayment enforcement takes place.

But the important point is that unemployment is not the same as loan forgiveness.

If you graduate, remain unemployed and have no income, you should not assume that your NELFUND debt has disappeared.

Instead, you should follow the procedure provided by NELFUND for documenting your employment and income status.

Does Unemployment Cancel the NELFUND Loan?

No.

There is nothing in the repayment provision that says a beneficiary’s loan automatically disappears because the person is unemployed.

The law establishes NELFUND’s responsibility to recover debts owed to the Fund, while providing specific circumstances in which enforcement can be delayed or repayment obligations may be exempted.

NELFUND’s own terms also state that borrowers remain personally liable for loans paid to their institution or to them for upkeep, whether or not they eventually graduate from the institution.

Therefore, an unemployed graduate should think of the situation as a delay or extension of enforcement, not a cancellation of the loan.

What Happens When You Eventually Get a Job?

Once you secure employment, your repayment obligation can become applicable.

The 2024 Act provides for monthly deductions of not more than 10% of the beneficiary’s gross income until the loan and applicable charges have been repaid.

NELFUND’s current loan terms similarly state that 10% of the borrower’s monthly salary will be deducted at source for loan repayment.

The terms also require borrowers to update their employer information on the NELFUND portal when they become employed or change employers.

For example, if a beneficiary eventually gets a job, the repayment arrangement may be connected to the person’s employment and income rather than requiring the graduate to immediately pay the entire loan at once.

How Much Will NELFUND Deduct From Your Salary?

The 2024 Act provides that repayment shall be made through monthly deductions not exceeding 10% of the beneficiary’s gross income until the loan and applicable charges are repaid.

This is important because the law does not say that NELFUND should take your entire salary or demand the full loan amount immediately from an employed graduate.

The repayment is structured around monthly income deductions.

NELFUND’s current terms also state that 10% of monthly salary shall be deducted directly from source for repayment.

What If You Become Self-Employed?

Getting a job does not necessarily mean working for a company.

The 2024 Act defines employment broadly to include economic activities that generate income through external sources or personal endeavors.

NELFUND’s current loan terms specifically address beneficiaries who become self-employed.

The terms require a self-employed graduate to update NELFUND within 60 days of becoming self-employed and provide information about the business, including its name, address, registration documents where applicable, bankers and information about partners, directors or shareholders.

So, becoming self-employed does not automatically mean you are outside the repayment system.

Can NELFUND Recover the Money From Your Bank Account?

This is one of the most important parts of the repayment terms for beneficiaries to understand.

NELFUND’s current terms state that borrowers consent to the use of legal recovery methods, including a Global Standing Instruction (GSI), if they fail to repay when repayment becomes due.

NELFUND’s current GSI information explains that the mandate allows the Fund to initiate recovery from money held in the borrower’s accounts across financial institutions if the borrower fails to repay. The Fund describes the GSI as a last-resort recovery mechanism.

This means beneficiaries should not interpret the unemployment provision as permission to deliberately avoid repayment once the loan becomes due.

What Happens If You Refuse to Repay?

Being unable to find a job is different from deliberately refusing to repay a loan that has become due.

The 2024 Act gives NELFUND powers to recover loans through legal means, including debt-recovery action.

The current NELFUND terms also state that the borrower consents to legal recovery measures, including the GSI, where the loan is due and remains unpaid.

Therefore, beneficiaries should not simply ignore the loan or assume that nothing will happen because repayment has not yet started.

If your employment or income situation changes, keeping your information updated with NELFUND is important.

Can NELFUND Forgive a Student Loan?

The 2024 Act does provide circumstances in which a beneficiary may be exempted from repayment.

The Act states that the Fund’s recovery objective is subject to circumstances where the Board considers that a borrower should be exempted because of death or incapacitation that makes repayment impossible or creates undue difficulty.

This is very different from simply being unemployed.

There is no general provision saying that every graduate who cannot find a job will have their NELFUND loan cancelled.

What If You Never Get a Job?

This is one area where beneficiaries should be careful about drawing conclusions.

The law provides protection for a beneficiary who is not employed and is not receiving income, including the possibility of an extension through the required sworn statement.

However, that does not mean the outstanding loan automatically disappears after a particular number of years.

The debt remains subject to the applicable law, NELFUND’s procedures and any valid extension or exemption.

If your circumstances change, such as getting a job or beginning an income-generating business, you should update NELFUND as required.

What If You Get a Job Before Two Years After NYSC?

The law distinguishes between the commencement of repayment and NELFUND’s enforcement powers.

Section 28 says repayment begins after graduation once employment is secured, while also stating that NELFUND cannot initiate enforcement action until two years after completion of NYSC or exemption from it.

Because these provisions can be misunderstood, beneficiaries should follow the repayment instructions communicated by NELFUND rather than assuming that the two-year period means they can ignore any repayment communication received after securing employment.

What Should an Unemployed NELFUND Beneficiary Do?

If you have graduated and have not found employment, the safest approach is not to simply forget about the loan.

Instead:

  • Keep your NELFUND account information updated.
  • Monitor official communication from NELFUND.
  • Keep evidence of your employment status where necessary.
  • Follow any procedure NELFUND provides for requesting an extension.
  • Do not provide false information about your employment or income.
  • Update your details if you eventually get a job.
  • If you become self-employed, follow NELFUND’s requirements for reporting your business and income information.

The 2024 Act specifically makes it an offence to provide a false statement to obtain the unemployment-related extension.

NELFUND Repayment: What Graduates Should Remember

The simplest way to understand the system is this:

No job does not automatically mean no loan.

An unemployed graduate may have protection against immediate enforcement and may be able to obtain an extension by following the procedure set out under the law. But the outstanding loan does not simply disappear because the graduate has not found work.

Once the beneficiary becomes employed or begins earning income through self-employment, repayment obligations can apply.

And once repayment becomes due, NELFUND has legal mechanisms available to recover outstanding loans.
